Message From Tom Westfield to
our PARA members:
We have been
advised by Tom Westfield that he has filed a complaint in the court in
connection with the E-ZPass issue and we wanted to let you know about
this if you were not already aware of it.
The following is
an excerpt from Tom Westfield's message to the PARA Board:
As a courtesy, I am informing you, and the PARA Board
that I have filed a complaint in Morris County Superior Court alleging
that the Port Authority Breached its Promise, Breached its Contract, Is
Estopped from Removing the Benefit, and is Unjustly Enriching itself. I
have also asked for certification as a Class Action and have
defined the Class as anyone who is retired, and filed a timely Notice
of Claim regarding the E-ZPass issue. Although PARA has
"no dog in this fight," the statute runs on December 31, 2011
with the last date to file (provided you gave Notice), apparently,
by the close of business on December 30, 2011.
Any of your members who meet that criteria, and desire
to do so, may institute their own action.
