E-ZPass Class Action - Tom Westfield - 2011

 

 

Dear Brothers and Sisters

As you are aware, I have been working on developing a strategy to deal with the E-ZPass problem.  Since the PA can only be sued by persons who have filed Notice that they wish to proceed against them, I believe every retiree should file a Notice of Claim indicating they wish to sue for this benefit.

Under the law you have to tell the PA you are suing them by sending a Notice that outlines who you are, where you live, the basis for your claim, and it must be notarized.  Once that's sent by Registered Mail, return receipt, you have to wait 60 days to institute the suit which has to be accomplished within one year of the date the claim originated.  A number of  attorneys have suggested a class action may exist consisting of all persons who filed timely Notices of Claim.

I have included a copy of a Notice of Claim which can be filled out and sent to the PA. It must be notarized and sent by registered mail or delivered in person.  The sooner this is done, the sooner the class will be determined and we can get the process started.

When you file, PA Civilian retirees are encouraged to file as well, I would appreciate if you would notify me by email at
* EZPassLitigation@aol.com that you have filed. Please include your retirement status such as PBA, SBA, LBA, DEA or CIV.  If you have a scanner, a copy of the filed Notice would be helpful also.
 
I urge every retiree, regardless of your represented status or not,  wherever you live, or even if you don't think you will ever use this benefit, to FILE.  Erosion of benefits now will embolden the PA in the future.  Your medical benefits may be next!!
